Dear Mr. Margolin:
On August 14, 2019, the U.S. Department of Health and Human Services (HHS), Office for Civil Rights (OCR), received your complaint against Renown Health in Reno, Nevada. In your complaint, you allege that Renown Health is not in compliance with the Federal Standards for Privacy of Individually Identifiable Health Information and/or the Security Standards for the Protection of Electronic Protected Health Information (45 C.F.R. Parts 160 and 164, Subparts A, C, and E, the Privacy and Security Rules) and the Breach Notification Rule Subpart D - Notification in Case of Breach of Unsecured Protected Health Information (PHI) (45 C.F.R. § 164.400 - 164.414). Specifically, you state that you received a notification letter from Renown Health stating that its employee misplaced a thumb drive that contains your Protected Health Information.
OCR enforces federal civil rights laws which prohibit discrimination in the delivery of health and human services based on race, color, national origin, disability, age, sex, religion, and the exercise of conscience, and also enforces the Health Insurance Portability and Accountability Act (HIPAA) Privacy, Security and Breach Notification Rules.
OCR has decided to consolidate your allegations into an existing complaint, OCR Reference Number 19-353517, in which OCR is reviewing similar allegations. Accordingly, we are closing the above complaints (i.e., Reference Number 19-353946) effective the date of this letter. We will notify you of the outcome of the complaint into which your complaint was consolidated.
