The Court:  Next we have, on the 10 o'clock calendar, Patrick Canet and Mr. Zandian, case number 16-50064. Appearances.

 

Mr. Holley:  Good morning, Your Honor. This is Richard Holley on behalf of Mr. Fred Sadri in his individual capacity and as trustee for the Star Family Living Trust. Also on behalf of Ray Koroghli individually and as a trustee of the Koroghli Management Trust.

 

Mr. Francis:  Good morning, Your Honor. This is Matthew Francis on behalf of Jed Margolin.

 

Mr. Zorio: This is Arthur Zorio on behalf of Jed Margolin as well. Good morning.

 

The Court:  Morning. So we want to dismiss this case. Is that correct?

 

Mr. Holley:  Your Honor, if I could, the Court heard it here and had its hearing on January 2nd to dismiss the case and there was no objection to the dismissal, but our client and Mr. Margolin requested a continuance of the hearing in order to discuss a mutually agreeable resolution to a number of the issues including the pending Adversary proceedings, and that was taking place outside of the bankruptcy case. We have been working diligently with opposing Counsel toward a mutually agreeable resolution, but it has been rather complicated with a lot of moving parts and we would request, Your Honor, the Court's indulgence in another 45 day continuance so that we can complete these negotiations and hopefully move forward with dismissal of the case at that time.

 

The Court:  Is that acceptable to everyone who's on the line?

 

Mr. Francis:  Yes. [crosstalk 00:01:54].

 

The Court:  No one opposing that? Okay. So you said about 35 days, Mr. Holley, is that correct?

 

Mr. Holley:  45 days, Your Honor, if that's possible.

 

The Court:  45. We can find you something nearly 45 days, I'm sure.

 

The Clerk:  Yes, Counsel, we have either May the 27th at 10:00 AM or June the 10th at 2:00 PM.

 

Mr. Holley:  Bear with me just one minute, if you would please.

 

The Court:  Sure. Please. Everybody take a look at your calendars and see which will work.

 

[Silence]

 

Mr. Holley:  Your Honor, either one of those days works fine for me. And again, this is Richard Holley.

 

The Court:  Anyone else want to weigh in?

 

Mr. Francis:  Yes, Your Honor. This is Matthew Francis. Either one of those dates work for us as well and there is one other issue we wanted to raise. Mr. Holley, please correct me if I'm wrong, but there is a pending Adversary proceeding, which is Adversary number 19-05025 that was instituted by Mr. Hartman. Mr. Hartman agreed to a voluntary dismissal of that action on February 18th. Mr. Holley graciously prepared a voluntary notice of dismissal and we've had numerous requests to Mr. Hartman to execute that and sign it, and file it rather, but we have not heard back from Mr. Hartman about that. So we may ultimately need to file a motion to dismiss that adversary complaint, but I believe that was also set for today's hearing as well, if I'm not mistaken.

 

The Court:  Yeah, it was. When is it set?

 

The Clerk:  It's the final matter on calendar, Your Honor.

 

The Court:  Hmm. That's unlike Mr. Hartman not to be on the line. Okay, so go ahead.

 

Mr. Holley:  Your Honor, this is Richard Holley. I was going to say in the event that we do need to file a Motion to Dismiss that Adversary proceeding, it may be better to take the June 10th hearing date as opposed to May 27th hearing date.

 

The Court:  June 10th day is yours.

 

The Clerk:  At 2:00 PM.

 

Mr. Holley:  Thank you, Your Honor.

 

The Court:  Okay.

 

The Court:  Yeah. Let's see what's next.

 

The Clerk:  And I believe that should conclude this morning's calendar, Your Honor.

 

The Court:  Okay. And the other portion of it is this afternoon with Mr. Hartman?

 

The Clerk:  No, that is on this calendar as well. I believe all three matters will continue to June the 10th.

 

The Court:  Okay. Anything further gentlemen?

 

Mr. Holley:  No, Your Honor. I think that if we are able to get a resolution, we will advise the Court and set a hearing date earlier, probably. But we'll certainly use that. The June 10th one the Court provided for us. Thank you so much.

 

The Court: Thank you very much.

 

Mr. Francis:  Thank you, Your Honor. This is Matthew Francis.
