This matter is before the Court on a Motion to Strike filed on January 23, 2012. An Opposition to Motion to Strike was filed on February 2, 2012. A Reply in Support of Motion to Strike as filed on February 13, 2012. A Request for Submission was filed on February 13, 2012.

Based on this Court's Order Denying Defendant's Motion to Dismiss entered on February 21, 2012, the Motion to Strike is moot. Therefore, good cause appearing,

IT IS HEREBY ORDERED that the Motion to Strike is DENIED.
