Order Holding Defendant in Contempt of Court
This matter is before this Court pursuant to Plaintiff s Motion to Show Cause Regarding Contempt and Ex Parte Motion For Order Shortening Time filed on January 14, 2016. Thereafter, this Court issued an Order to Show Cause on January 22, 2016. A hearing was held on the matter on February 3, 2016. Present on behalf of Plaintiff was Adam McMillen, Esq. Defendant failed to appear.
Based on Defendant's failure to comply with this Court's Order and additionally failing to appear before this Court, Defendant is in contempt of this Court pursuant to NRS 22.010.
Therefore, based on the foregoing and good cause appearing,
IT IS HEREBY ORDERED that Defendant shall be held in contempt of Court, a bench warrant shall be issued, and the Plaintiff is duly awarded his attorney fees incurred as a result of the contempt.

On May 19, 2016 French Liquidation Attorney Patrick Canet (“Canet”) acting as Zandian’s proxy filed a fraudulent Chapter 15 Petition in U.S. Bankruptcy Court For The District of Nevada (Case: 16-50644-btb). Canet’s Chapter 15 Petition was based on a 1998 Judgment against Zandian in France (the 1998 French Action) in which the French Court had ordered Zandian to personally pay the debts of his bankrupt French company, Computer World.
Canet’s Chapter 15 Petition was fraudulent. In 2019 Margolin hired French Attorney Maître Isabelle Victoria Carbuccia, Attorney to the Appeal Court of Paris, to look into the French case. She provided an Affidavit which stated, among other things, that under French law judgments (even bankruptcy judgments), cannot be enforced after 10 years. Canet’s Chapter 15 was based on the 1998 French Action. When he filed his Chapter 15 Petition in May 2016 it had already become unenforceable. In addition, in discovery Canet admitted that he had filed his Chapter 15 Petition after being contacted by Zandian in 2016. Therefore, the evidence shows that Canet had been acting as Zandian’s proxy in a fraudulent attempt to avoid Margolin’s Default Judgment. Maître Carbuccia’s affidavit led to Canet’s Chapter 15 being dismissed on October 20, 2020 with prejudice and the Interlocutory Order ordered vacated and void ab initio.

Zandian appealed the Court’s ORDER GRANTING PLAINTIFF’S MOTION TO VOID DEEDS, ASSIGN PROPERTY, FOR WRIT OF EXECUTION AND TO CONVEY (Case No.: 82559). The Nevada Supreme Court dismissed Zandian’s appeal for being non-statutory making it clear that post-judgment orders for executing on a judgment that do not affect rights already incorporated in a judgment are not appealable. (Supreme Court Doc 22-05224.) Margolin’s Default Judgment against Zandian did not give Zandian any rights. It gave Zandian only the duty to pay money to Margolin, which Zandian refuses to so. Remittitur was issued June 1, 2022.

Zandian filed a Petition For Rehearing. It was denied.
Then he filed a Petition For En Banc Reconsideration. It was also denied.
